Terms & Conditions
That-Dress Ltd CONDITIONS OF HIRE:
All Goods being returned must be received by 13.00hours on the Return Date.
That Dress Ltd’s liability is limited in any event to the value of the Contract between the Customer and That Dress Ltd (the cost of Hire paid by the Customer).

Definitions:
- “Goods”

- means any outfit or part of an outfit that together would constitute one outfit, or in the case that only part of such an outfit is hired to the Customer, that part
- “Receipt”

- means the date advised by the customer at the time of the formation of the Contract for the intended delivery of the Goods from That-Dress Ltd
- “Store”

- refers to the e-commerce site www.that-dress.net and any events hosted by That Dress Ltd at any such venue
- “Event Date”

- means the date advised by the customer at the time of the formation of the Contract for the intended delivery of the Goods from That-Dress Ltd
- “Return Date”

- means the date agreed at the time of the formation of the Contract between the Customer and That-Dress Ltd for the outfit and any accessories or constituent parts to be returned to and received by That-Dress Ltd
- “Grand Total”

- that value listed in the Agreement form at the time of laying down the hire order. This may be subject to change by alteration, addition or removal of chargeable item or items and/or amend to the Event date and/or Return Date
- “RRP”

- the listed and advertised retail price on www.that-dress.net forming the value of the outfit, including any accessories, that will be used in the event of damage, loss, failure to return or any other dispute on the Goods

Existence and Scope of Contract
These terms and conditions of hire, together with the Receipt, form a Contract for the hire of Goods between the Customer and That Dress ltd, to the exclusion of all other express or implied terms and conditions.

Variation
The terms of the Contract may only be varied by the Customer on the receipt of a document signed by the Customer confirming the agreed amendment. A surcharge maybe payable by the Customer if the Contract is varied in any way which includes but is not limited to a change in the Return date.

Hire Period
Goods will be sent by Royal Mail Next Day Delivery, a signed for service, to the address provided by the customer to arrive no later than the advised Event Date. The Goods must be returned using the provided Return details no later than the stated Return Date or the Customer will be held liable.

Payment and Deposits
If the rental is within the next 60 days, full payment will be taken at the time of ordering and forming the Contract. If the Contract is for a period 61 days out or further, an initial payment (normally of 50% of the total hire value) must be paid. The balance will automatically be deducted one week in advance of the shipping of the outfit.
If you receive the Goods and they are not to your satisfaction or do not fit, you must inform That Dress Ltd immediately by email to theteam@that-dress.net and return the Goods on the same day. You will receive a full refund of the hire value of the outfit.

Loss, Damage and Accidental Damage Waiver (ADW)
A mandatory fee of £3.95 is included in the Contract to be paid by the Customer to cover the ADW. The ADW provides cover for the Customer in respect of all accidental damage occurring to the Goods whilst in the possession of the Customer, with the exception of malicious damage. Non-return, loss and theft are not covered by the ADW.
The Customer is responsible for and will indemnify That Dress Ltd against any loss or damage to the goods whilst in the possession of the Customer. In the event that the Goods are not returned from hire at all, are lost, or are damaged and not covered by the ADW, That Dress Ltd will pursue the recovery and return of the Good or any monies outstanding to the full and listed RRP as listed on www.that-dress.net at the time of entering into the Contract of the goods in question.

Sizes
The Customer undertakes to ensure that the size they order is their standard size of clothing. That Dress Ltd will make every effort to provide accurate sizing information to the Customer.

Surcharges
Surcharges will be added if required by our agents for events including but not limited to changes to delivery details, additional cleaning, late returns or non-payment of Contract.
Late returns will incur the full rental payment and any lost income until the RRP plus £35.00 processing fee has been reached.

Cancellations
Should you wish to cancel a Contract six or more working days before the Event date you will receive a full refund. Orders cancelled with less than five or less working days will be subject to a £10.00 processing charge.
The refund on any monies taken will be processed no later than seven working days after the Return Date in the Contract.

Delivery and Returns
Delivery of the Goods is by signed for Royal Mail post and will be with you before 13.00hours on the Event Date. Goods that are being returned because of a fault, the size is not suitable or any other reason must be returned on the same day and deposited at the Post Office before 15.00hours.
ALL CUSTOMERS ARE REQUIRED TO:
Check your order carefully. Ensure it is correct, complete and in good order immediately on receipt.

That Dress Ltd cannot be held responsible for any error which is not reported or discovered later.
To ensure fit, That Dress Ltd provides detailed information on each outfit either online or via The Team. Please try on your outfit as soon as your receive it and inform That Dress Ltd if there are any problems.

Limitation of Liability
That Dress Ltd will use its reasonable endeavours to rectify any errors but will not be liable for any loss, loss of profit or any indirect or consequential loss suffered by a Customer which could have been avoided.

Governing Law
The Contract will be governed by the laws of England and Wales. The English and Welsh Courts will have exclusive jurisdiction to settle any disputes which may arise out of or in connection with this contract.
